New Texas law would allow legal documents to be served on Facebook

(WOAIChecking your Facebook status could land you in court, under a measure introduced in the Texas Legislature.

1200 WOAI news reports that State Rep. Jeff Leach (R-Plano) has introduced a bill which would allow legal process, from lawsuits to divorce papers to criminal complaints, to be legally served on a person via social networking web sites.

Leach says his bill includes several provisions ensuring that the defendant receives the legal process.

"The defendant must maintain a social media page on the particular web site," Leach said.

"It also has to be known that that the person on the page is the defendant in question, and it has to be 'reasonably expected' that the defendant will regularly access the social media page account and will receive actual notice."

Reasonable expectations would include evidence that the individual updates his or her status daily, or frequently posts photographs and other items to the social networking site.
